Protection of adjoining properties
Protection work notices
If you have been served with protection work notices related to proposed building work on an adjoining property you will need to review the documentation provided and complete the response notice. Understanding drawings and detailed documentation can be complex, so you can engage your own building surveyor or structural engineer to help review the proposal.
VBA (BPC) Protection Work Approved Statement provides a detailed explanation of the protection work notice process and involvement of each party.
Serving protection work notices on Council
Your relevant building surveyor may determine that you need to serve protection work notices on Council, as your proposed building work affects a Council-owned building, Council park, street, road or laneway under the control of Council. If this is the case, you will need to compile all relevant documentation listed below and then send an email. Click here to send the email

Emergency procedures
In certain circumstances, dangerous situations may arise due to building work. These matters will need to be raised with the relevant building surveyor (who issued the building permit for the building work) or the Building and Plumbing Commission. Only the Building and Plumbing Commission has the power to require emergency protection work. Contact the Building and Plumbing Commission.
Requesting adjoining property ownership detail to serve protection work notices
As the owner required to serve protection work notices, you must take reasonable steps to find the name and address of the owner of the adjoining property. If you cannot find the name and address of the adjoining owner, you may lodge a written request to Council for these details. Under section 84B of the Building Act 1993, Council may disclose the name and address information of the owner of adjoining properties.
