Errors and Anomalies Amendment C145hbay
About the Amendment
Amendment C145hbay seeks to correct mapping and text anomalies to ensure the ongoing accuracy of the Hobsons Bay Planning Scheme.
The errors and anomalies amendment proposes to:
- Amend Schedules 1, 2, 3, and 5 to Clause 37.01 Special Use Zone to be consistent with the latest state and local policies.
- Amend Schedule 2 to Clause 37.02 Comprehensive Development Zone to correct formatting and clause reference anomaly.
- Amend Schedule to Clause 43.01 Heritage Overlay to reference correct year for all incorporated Heritage Design Guidelines.
- Amend Schedule 11 to Clause 43.02 Design and Development Overlay to:
- replace Map 1 with a new map that reflects all land affected by DDO11 (include 23 Ann Street, 26 Windsor Terrace, and 28 Windsor Terrace Williamstown which were previously omitted).
- delete duplication from section 6.0 decision guidelines.
- Amend Planning Scheme Map 19DDO to remove DDO11 from the rear of 16 Cecil Street, Williamstown.
- Amend Schedule 14 to Clause 43.02 Design and Development Overlay to reference Council’s updated background document Social Impact Assessment Guidelines: Residential (Hobsons Bay City Council 2022).
- Amend Planning Scheme Map 8PAO to remove Public Acquisition Overlay 1 from Kororoit Creek Road in the section adjacent to the Altona Gardens Industrial Estate, formerly 361-399 Kororoit Creek Road, Altona.
- Amend the Schedule to Clause 66.04 Referral of Permit Applications under Local Provisions to reflect updated referral authority.
Current status
On 23 September 2025, Council resolved to request authorisation of Amendment C145hbay from the Minister for Planning and to progress to public exhibition. Council received authorisation with conditions on 12 March 2026. The conditions have been addressed and adopted in the amendment documentation. The amendment will be on public exhibition from 6 May to 17 June 2026. Further information about the amendment, including details of the proposed planning scheme changes and how to make a submission are available on the Participate Hobsons Bay website from 6 May 2026.
Where to next?
Following public exhibition, Council will review all submissions received and determine if a Planning Panel will be required.
If a Planning Panel Is Required
The Minister for Planning may decide to appoint an independent planning panel to consider submissions received to the amendment. Anyone who makes a submission will have the opportunity to be heard by the planning panel. The panel will make recommendations to the Council on the amendment following the panel hearing.
Council will consider the recommendations of the panel and decide to adopt or abandon, part or all of the amendment. If adopted by Council, the amendment will be submitted to the Minister for Planning for approval.
If No Planning Panel Is Required
If no planning panel is required, Council will determine whether to adopt or abandon, part or all of the amendment. If adopted by Council, the amendment will be submitted to the Minister for Planning for approval.
