Building over an easement
A person may make an application to place a building over an easement (including a roof eaves overhang).
An easement is described on the title to the land and is vested in the interest of the Council. The easement may contain sewer only, stormwater drainage only or a combination of both. It may also be empty or contain other services such as power, gas or water.
Should you wish to make an application to build over the easement the applicant should seek the service authorities approval prior to making the application.
Documentation to be submitted with your application:
- two (2) copies of plans showing the type, size and location of the proposed building and the position of the easement;
- one (1) copy of the certificate of title;
- consent from the sewerage authority (for combined sewerage and drainage easement); and
- payment of $232.95 fee. A further $361.00 is required (once informed) if a Legal Agreement is necessary.
